Before appointing an Inquiry Officer — the most common way inquiries get struck down
- The Inquiry Officer must not be the person who issued the charge sheet.
- The Inquiry Officer must not be a witness to the alleged misconduct.
- The Inquiry Officer must not be the authority who will decide the final punishment.
- The Inquiry Officer must have no personal connection to the complainant or the employee.
If a domestic inquiry is not conducted in line with these principles of natural justice (audi alteram partem — right to be heard, and nemo judex in causa sua — rule against bias), a labour court can discard the inquiry's findings entirely and examine the misconduct afresh itself.
