The timelines and safeguards that make or break a POSH inquiry

7 days — the complaint copy must reach the respondent (Section 11(1)).
10 working days — the respondent's window to file a reply with the ICC.
90 days — the entire inquiry must be completed from the date of the complaint (Section 11(4)).
10 days — the ICC's report must reach the employer after the inquiry is complete (Section 13(1)).
60 days — the employer must act on the ICC's recommendations after receiving the report (Section 13(4)).
Confidentiality (Section 16): the identity of the complainant, respondent, witnesses, and the contents of the inquiry are not to be published or disclosed — only the outcome. Breaching this is itself a punishable offence under Section 17.
Section 14 caution: a complaint that simply isn't substantiated is not the same as a false or malicious complaint — action against the complainant under Section 14 requires the ICC to affirmatively establish malicious intent, not merely that the charge wasn't proved.

Conciliation under Section 10 must never involve a monetary settlement, and is only ever undertaken at the written request of the complainant — the ICC cannot initiate or pressure it.
